1. I am based overseas and I would like
to own a lot or a home in one of your projects, what is the most
convenient way or procedure for me to pay for my purchase?

The best way to pay for your property is for you to open a local
peso current / checking account and issue post-dated checks to Active
Construction, Inc. The company will then deposit each check in its
respective date/s and issue the corresponding receipt/s to you.
Once cleared, your check/s also serves as your proof of payment.
If you do so desire and upon your request, we can scan your receipts
and email them to you for record purposes, until you are able to
retrieve it from the office upon your arrival. |

2. Is it possible for any person to avail and make use
of Town & Country Clubhouse and any of its facilities?

The Clubhouse of Town & Country, including all the facilities
therein are for the exclusive use of lot owners, homeowners and
their guests only.
Should one desire to use the facilities of the said exclusive community,
it is recommended that you get in touch with any lot owner, homeowner
or come to our office to facilitate your visit and use of such facilities. |

3. Can Filipinos who have assumed foreign citizenship own
properties in your various projects?

Yes. Applicable laws dictate that any natural born persons of Philippine
descent, who have lost their Philippine citizenship, can still own
real estate properties in the country within certain limitations. |

4. Can foreigners own properties in Town & Country?

Existing Philippine laws provide ownership of real
estate in the country for Filipino citizens only, Active Construction,
Inc. does accommodate long-term property lease for those who are
qualified. The said leasehold right is also transferable to bonafide
heirs or to a designated beneficiary of the lessee for the duration
of the unexpired term of the lease.
This 25-year lease is applicable to lots and house & lot purchases
and is renewable and extendable by another 25 years. However should
a pending proposed law allowing foreigners to own properties in the Philippines,
eventually passed, full ownership of the particular property may
now be assumed by the lessee concerned, upon accomplishment of documentary
requirements including payment of certain fees. |

5. Are there any monthly fees or dues payable by lot owners
or homeowners?

Town & Country Negros Homeowners & Lot Owners Association,
Inc. is the entity that determines and collects the monthly fees
involved from individual homeowners / lot owners. All owners of
the said subdivision automatically become members of the Association
and thus help set the fees involved.
This monthly fee is primarily used for maintenance such as, but
not limited to; security guards, garbage collection, maintenance
of the clubhouse complex and sports facilities, etc. This minimum
monthly fee is on top of the PhP 6 M trust fund that Active Construction,
Inc. has put in place and may be changed from time to time as the
Association may deem proper and fit.
As of the first quarter of 2002, the fees set by the Association
are as follows:
Lot owners: PhP 100.oo / lot / month
Homeowners: 1.oo / sq. mt. / month, for the first 300 sq. mts. of
lot
0.75 / sq. mt. / month, for 301 - 1000 sq. mts. of lot
0.50 / sq. mt. / month, for 1001 sq. mts. and above |

6. What is the water source or water system for Town &
Country and can individual homeowners drill their own deep wells
as water source?

Town & Country has a 100,000 gallon overhead treated water tank
to supply the water needs of the whole residential community. Another
water system is planned for construction should there be more actual residents
in the said community.
Since treated water supply is guaranteed, Active Construction, Inc.
does not allow individual homeowners to have their own deep wells
constructed, as this will tend to contaminate the main water source
where water supply for the whole community is taken from. |

7. I am a Filipina with a foreign spouse, how can I own
a piece of Town & Country?

You can readily own
a lot or house and lot in Town & Country with the property named
under you. By virtue of your marriage to a foreign spouse, his name
will also appear in the title / deed. |
